Transfer of home ownership in cases of permanent absence from the country (Legal Norm General Housing Law Art. 81 et seq.).

The permanent residence dwelling, whose owner has definitively left the country, is confiscated by the State in order to be able to transmit its property to the people who are entitled to it, in accordance with the provisions of this Law. They have the right to transmission free property:

  • Co-owners.
  • Spouse, children and other descendants.
  • Parents, grandparents and other ancestors.
  • Brothers and nephews.
  • Uncles
  • Cousins.

The transfer of the property will be done in the order in which they appear in the preceding section, and one excludes the following. The spouse and children who will concur with the same right are excepted.

Whoever is awarded the home, in the previous cases, has the obligation to settle the debts that were left with the Bank on it.
